Bankrupts can leave the country
We are sometimes asked if bankrupts can leave the country, and the answer is yes. Now, it is important to recognize the difference between leaving the country and fleeing the country.
If someone files for bankruptcy then skips out of the country taking assets and leaving no contact information they may have committed an offence under the Act. But that is a very different case scenario than an individual who is planning to leave the country for a short term such as vacation or for a longer term to pursue employment in another country.
The processes of filing a bankruptcy or proposal are not criminal by nature so they impose few restrictions on people who use them to deal with urgent debt problems.
